FMM Workshop on Conducting a Domestic Inquiry for Employment Misconducts
Managing employee misconduct is one of the most challenging responsibilities of any employer. While employers have the managerial prerogative to discipline employees, disciplinary action particularly dismissal must be exercised fairly, consistently, and in accordance with the law. The concept of natural justice and the employee's right to be heard have become firmly established under Malaysian employment law. Following the amendments to the Industrial Relations Act 1967, effective January 1, 2021, representations relating to dismissals that remain unresolved through conciliation are generally referred to the Industrial Court for hearing. Consequently, employers must ensure that disciplinary decisions are supported by proper procedures and sufficient evidence.
A poorly managed disciplinary process or defective domestic inquiry can expose an employer to claims of unfair dismissal, resulting in costly litigation, compensation, reinstatement orders, and damage to employee relations. This two-day programme is designed to provide participants with a comprehensive understanding of the legal principles, procedures, and practical skills required to conduct a fair and legally defensible domestic inquiry. Through case studies, practical exercises, and a mock domestic inquiry, participants will gain the confidence to manage disciplinary proceedings in accordance with Malaysian employment law and accepted Industrial Court principles.
By the end of this programme, participants will be able to:
• Understand the legal principles governing employee discipline and domestic inquiries.
• Distinguish between minor and major misconduct and determine the appropriate disciplinary response.
• Conduct workplace investigations in a fair and systematic manner.
• Prepare legally compliant disciplinary documents, including Charge Sheets and Notices of Domestic Inquiry.
• Conduct domestic inquiries in accordance with the principles of natural justice.
• Examine and cross-examine witnesses effectively.
• Evaluate evidence objectively and apply the correct standard of proof.
• Prepare well-reasoned findings and recommendations.
• Reduce the risk of unfair dismissal claims by complying with accepted Industrial Court principles and best practices.
